Conditions of participation for the uNostics GmbH trade fair competition at "FIBO Global Fitness 2024"

 

Conditions of participation
These conditions of participation govern participation in the trade fair competition at FIBO Global Fitness 2024 from 11-14 April 2024 by uNostics GmbH, Osterwalder Str.12, 87496 Hopferbach (hereinafter referred to as the organizer). Participation in the trade fair competition is linked to the conclusion of a contract for the purchase of uVida Dynostics equipment and is governed exclusively by these conditions of participation.

Participants
Contractual partners who enter into a legally valid purchase contract/approved leasing contract for the uVida Dynostics metabolic analysis device with the organizer on the days of the trade fair (11-14 April) are eligible to participate. All employees of the organizer, their relatives or employees of cooperation partners who are involved in the competition are excluded from participation.
The prerequisite for participation in the competition is the purchase of goods from the organizer.

Procedure of the competition
The competition will take place from April 11-14, 2024. The following prize will be raffled off to the competition participants:
1 x uVida Dynostics analyzer including accessories (packaging case, mask, head harness, Polar heart rate monitor, disinfectant)
When a contract is concluded, the trade fair visitor automatically becomes a competition participant with their contract details. At the end of the trade fair, the winner will be drawn live via Instagram and notified.

Any disadvantages resulting from the provision of incorrect contact details shall be borne by the participant. Each participant may only participate once, even the purchase of several devices for the purpose of increasing chances does not qualify for multiple participation.
The organizer is entitled to exclude individual persons from participation, e.g. in the event of violations of the aforementioned conditions, false or misleading information in connection with participation in the competition or the conclusion of the contract, as well as in the event of a demonstrable attempt to manipulate or manipulation that has taken place.

Warranty
The organizer cannot guarantee the availability of the competition at the trade fair. The competition may be terminated prematurely due to external circumstances.

Determining the winners
The individual winner will be determined in a random draw on the last day of the fair. If the participant forgoes the prize, the next following participant in the draw will receive the prize. The winner will be drawn from all participants who have concluded a purchase contract for the uVida Dynostics device during the FIBO trade fair days.
The participants drawn will be notified by e-mail after the draw and asked in the e-mail to confirm that they accept the prize. If the participant does not confirm that they accept the prize within 7 days of receiving the notification, the next participant after them will be the winner.
The prize will be handed over exclusively to the winner. The prize cannot be exchanged or paid out in cash and cannot be transferred to third parties. Prizes in kind will be sent to the winner by post to the address stated in the contract; the organizer will bear the shipping costs. The winner is responsible for any taxation of the prize.

Termination of the competition
The organizer expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to amend these conditions of participation.

Liability and legal action
The organizer is not liable for damages caused by errors, delays or interruptions in transmission, malfunctions of the technical equipment and service, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition, unless such damages have been caused intentionally or through gross negligence by the organizer (its bodies, employees or vicarious agents). The above limitation of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects.
The competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

Data protection information
Participation in the competition requires the provision of personal data. The participant assures that the personal details provided by him/her, in particular first name, surname and address, are true and correct. The participant's contact details such as first name, surname, email address and address will be collected, processed and used to carry out the competition in accordance with the legal requirements. The data of participants in the competition will be stored as customer data for the duration of the collaboration. Participants' data will not be passed on to third parties or made available to them for use without their consent. Participants can obtain information about their data stored by the organizer at any time, object to the use of their data and request its deletion. An e-mail to datenschutz@uvida.de is sufficient for this purpose. Once consent has been withdrawn, the participant's personal data collected and stored will be deleted immediately. Further regulations on the handling of personal data can be found in the organizer's privacy policy at www.uvida.de/datenschutz.

Severability clause
Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
